Terms & Conditions for Kulturella
In force from 01.01.2024 · last amended October 2026
This is an English translation of the original Norwegian terms and conditions (“Brukervilkår”). In case of any conflict or inconsistency between this translation and the Norwegian original, the Norwegian version shall prevail. Read the Norwegian original at kulturella.io/brukervilkar.
1. Who the agreement is between
These terms are an agreement between you as a user and Kulturella AS, organization number 927167980, Naustskaret 2, 6409 Molde, Norway. The terms apply to the website kulturella.io, the Kulturella app, and all services we offer there, including the AI assistant ELLA.
You accept these terms when you create an account or use the service. If you do not accept the terms, you may not use the service.
How we process personal data is described in the privacy policy at kulturella.io/privacy-policy. It forms part of this agreement.
2. Who can use Kulturella
You must be at least 16 years old. If you create an account on behalf of a business or organization, you confirm that you have the authority to bind it to these terms. In that case, the business is the party to the agreement.
Kulturella is in a test phase (beta) until launch. This means features may change, be added, or be removed without notice, and errors may occur.
3. Your account
You are responsible for what happens on your account. Keep your password to yourself. Let us know at post@kulturella.no if you believe someone else has gained access to your account.
The information you provide about yourself must be accurate. You may only have one personal account. You can delete your account at any time under Settings > Account.
4. Your content
You own everything you post on Kulturella: text, images, audio, video, CVs, references, and project descriptions.
So that we can show your content to other users, you grant Kulturella a free, non-exclusive right to store, display, adapt the format of, and distribute your content on the platform. This right applies for as long as the content remains on Kulturella and ends when you delete it or your account, except for copies in backups, which are deleted within 30 days.
We do not use your content for marketing outside the platform without asking you first.
Public profile page. By default, your profile is also shown to visitors who are not logged in and may be found by search engines such as Google. The public page shows only your name, profile picture, title, artistic fields, city and the beginning of your biography. Contact information, documents, CVs, references and the ability to send messages require login. You can turn this off at any time with the option “Show my profile outside Kulturella” under Edit profile.
You confirm that you have the right to post the content, and that it does not infringe on others’ copyright, privacy, or other rights. If you post images or information about other people, you must have their consent.
5. Content from others
Content from other users and from partner organizations (for example, guides in the Knowledge Portal) belongs to whoever created it. You may read and use it for your own work, but not copy, redistribute, or sell it without permission from the owner. Where other terms are stated alongside the content, those apply.
Kulturella does not review content from others before it is published and does not guarantee that it is accurate or suitable for your purposes.
6. Rules of use
You may not use Kulturella to:
- harass, threaten, or discriminate against others
- post content that is illegal, misleading, or infringes on others’ rights
- impersonate someone else
- send mass mailings, advertising, or content not relevant to the cultural sector
- systematically extract data about other users, manually or with tools
- disrupt operations, circumvent security, or copy the platform
Contact between users is at your own risk. Kulturella is not a party to agreements users enter into with each other, and does not guarantee payment, delivery, or quality in such collaborations.
7. ELLA and AI-generated suggestions
ELLA is an AI assistant. It provides suggestions for application texts, budgets, collaboration partners, and funding opportunities. The suggestions are not professional advice and may contain errors, outdated information, or misunderstandings.
You are responsible for reviewing everything ELLA produces before you use it, and for any content you submit to funding schemes, clients, or others.
ELLA uses a language model from an external provider. What you write to ELLA is sent to the provider to generate the response. Who the provider is and how the data is protected is described in the privacy policy. Do not enter information about others’ health, finances, or other sensitive matters into ELLA.
Text that ELLA produces for you may be used freely.
8. Paid services
The core features of Kulturella are free. Pioneer membership and other paid services have their own price, shown before you order. Payment is processed through Stripe.
Subscriptions renew automatically for a new period at the then-current price until you cancel. You can cancel at any time under Settings > Membership. Cancellation takes effect at the end of the period you have paid for. We do not refund payment for the remaining part of the period.
Price changes are announced by email at least 30 days before they take effect. You can cancel before the new price takes effect.
If you are a consumer, you have a 14-day right of withdrawal from the order under the Norwegian Right of Withdrawal Act. If you request that the service start immediately, you must pay for the part of the period you have used if you withdraw.
9. Kulturella’s rights
Kulturella AS owns the platform, the name, the logo, ELLA, and all software and design. You are granted a personal, non-transferable right to use the service under these terms. This right does not permit you to copy, modify, or build competing services based on the platform.
10. Liability
Kulturella is provided as is. We do our best to keep the service working, but do not guarantee that it is always available or error-free, nor that you will obtain assignments, collaboration partners, or funding through the platform.
Kulturella is not liable for losses arising from content from other users or partners, suggestions from ELLA, agreements between users, or circumstances beyond our control.
Towards businesses, our total liability is limited to what you have paid us over the past twelve months. Towards consumers, the liability rules of Norwegian law apply. Nothing in these terms limits liability for intent or gross negligence.
11. Suspension and termination
We may remove content or suspend your account if you breach these terms, in case of suspected misuse, or when required by law. For minor breaches, you will receive a warning and an opportunity to correct the issue first. For serious breaches, the account may be suspended without notice.
If we discontinue the service, you will receive at least 60 days’ notice and the opportunity to retrieve your content.
When an account is closed, your personal data is deleted according to the timeframes in the privacy policy.
12. Changes to the terms
We may change these terms. Material changes are announced by email at least 30 days before they take effect. If you continue to use the service after that, you accept the new terms. If you do not accept them, you may delete your account. Minor changes, such as corrections and clarifications, take effect from the date they are published, with a new date shown.
Previous versions are available on request.
13. Governing law and disputes
Norwegian law applies. Please contact us first at post@kulturella.no, and we will try to resolve the matter together.
If you are a consumer, you may file a complaint with the Norwegian Consumer Authority (Forbrukertilsynet) or use the EU’s online dispute resolution platform. Disputes that are not resolved are handled by Møre og Romsdal District Court (tingrett). Consumers may always choose the court where they live.
