1. Who the agreement applies between

These terms are an agreement between you as a user and Kulturella AS, organization number 927167980, Naustskaret 2, 6409 Molde. The terms apply to the website kulturella.io, the Kulturella app, and all services we offer there, including the AI assistant ELLA.

You accept the terms when you create an account or use the service. If you do not accept the terms, you cannot use the service.

How we handle personal data is stated in the privacy policy on kulturella.io/privacy-policy. It is part of the agreement.

2. Who can use Kulturella

You must be at least 16 years old. If you create an account on behalf of a business or organization, you confirm that you have the right to bind it to these terms. In that case, the business is the party to the agreement.

Kulturella is in test phase (beta) until launch. This means that features can be changed, added, or removed without notice, and errors may occur.

3. Your account

You are responsible for what happens on your account. Keep your password to yourself. Let us know at post@kulturella.no if you think others have gained access to your account.

The information you provide about yourself must be correct. You can only have one personal account. You can delete your account at any time under Settings > Account.

4. Your content

You own everything you upload to Kulturella: texts, images, audio, video, CV, references, and project descriptions.

In order for us to show your content to other users, you grant Kulturella a free, non-exclusive right to store, display, adapt the format of, and transmit the content on the platform. The right applies as long as the content is on Kulturella and ceases when you delete it or your account, except for copies in backups, which are deleted within 30 days.

We do not use your content for marketing outside the platform without asking you first.

Public profile page. Your profile is displayed by default also for visitors who are not logged in, and can be found by search engines like Google. The public page shows only name, profile picture, title, field of culture, city and the beginning of your biography. Contact information, documents, CV, references and the ability to send messages require login. You can turn this off at any time with the option "Show my profile outside Kulturella" under Edit profile.

You confirm that you have the right to upload the content, and that it does not infringe on others' copyright, privacy, or other rights. If you upload images or information about other people, you must have their consent.

5. Content from others

Content from other users and from partner organizations (for example, guides in the Knowledge Portal) belongs to the person who created it. You can read and use it for your own work, but cannot copy, transmit, or sell it without permission from the owner. Where otherwise stated in the content, that applies.

Kulturella does not review content from others before it is published and does not warrant that it is correct or suitable for your purpose.

6. Rules for use

You cannot use Kulturella to:

  • harass, threaten, or discriminate against others
  • upload content that is illegal, misleading, or infringes on others' rights
  • pretend to be someone else
  • send mass communications, advertisements, or content that is not relevant to the cultural field
  • systematically extract data about other users, manually or with tools
  • disrupt operations, bypass security, or copy the platform

Contact between users occurs at your own risk. Kulturella is not a party to agreements users enter into with each other, and does not guarantee payment, delivery, or quality in such collaboration.

7. ELLA and AI-generated suggestions

ELLA is an AI assistant. It provides suggestions for application texts, budgets, collaborators, and funding opportunities. The suggestions are not professional advice and may contain errors, outdated information, or misunderstandings.

You are solely responsible for checking everything ELLA produces before you use it, and for content you submit to support schemes, clients, or others.

ELLA uses a language model from an external provider. What you write to ELLA is sent to the provider to generate the response. Who the provider is and how the data is protected is stated in the privacy policy. Do not enter information about others' health, finances, or other sensitive matters into ELLA.

Text that ELLA generates for you, you can use freely.

8. Paid services

Basic functions on Kulturella are free. Pioneer membership and other paid services have their own prices, which are shown before you order. Payment is made through Stripe.

Subscriptions renew automatically for a new period at the current price until you cancel. You can cancel at any time under Settings > Membership. The cancellation applies from the end of the period you have paid for. We do not refund payment for the remaining part of the period.

Price changes are notified by email at least 30 days before they apply. You can cancel before the new price takes effect.

If you are a consumer, you have 14 days' right of withdrawal from the order under the right of withdrawal law. If you request that the service starts immediately, you must pay for the part of the period you have used if you withdraw.

9. Kulturella's rights

Kulturella AS owns the platform, name, logo, ELLA, and all software and design. You receive a personal, non-transferable right to use the service according to these terms. The right does not permit copying, modifying, or building competing services based on the platform.

10. Liability

Kulturella is provided as is. We do our best to ensure the service functions, but do not guarantee that it is always available or error-free, nor that you will obtain assignments, collaborators, or support through the platform.

Kulturella is not responsible for losses caused by content from other users or partners, suggestions from ELLA, agreements between users, or circumstances beyond our control.

Towards businesses, our total liability is limited to what you have paid us in the last twelve months. Towards consumers, the liability rules in Norwegian law apply. Nothing in these terms limits liability for intent or gross negligence.

11. Suspension and termination

We may remove content or close your account if you breach the terms, on suspicion of misuse, or when the law requires it. For less serious breaches, you will receive notice and an opportunity to correct first. For serious breaches, the account may be closed without notice.

If we discontinue the service, you will receive at least 60 days' notice and an opportunity to retrieve your content.

When the account is terminated, your personal data is deleted according to the deadlines in the privacy policy.

12. Changes to the terms

We may change the terms. Material changes are notified by email at least 30 days before they apply. If you continue to use the service after that, you accept the new terms. If you do not accept them, you can delete your account. Minor changes, such as corrections and clarifications, apply from the time they are published with a new date.

Previous versions are available upon request.

13. Governing law and disputes

Norwegian law applies. Contact us first at post@kulturella.no, and we will try to resolve the matter together.

If you are a consumer, you can file a complaint with the Consumer Authority or use the EU's complaint portal for online services. Disputes that are not resolved are handled by Møre and Romsdal District Court. Consumers can always choose the court where they live.
